INPI Overhauls Trademark Invalidation and Cancellation Proceedings
By means of Resolution No. 215/2026, the INPI approved new regulations governing the nullity and cancellation for non-use of registered trademarks, which replace in their entirety those previously in force. The new rules require any party bringing an action to demonstrate a concrete interest linked to the challenged trademark and to serve formal notice on the trademark holder prior to effecting service of the claim, subject to time limits that admit neither suspension nor extension. The resolution shall enter into force upon its publication in the Trademark Gazette.
